I. LATAM: TECHNOLOGICAL INNOVATION AND RECORDS IN CAPITAL INVESTMENT

As knowledge advances as a result of scientific research and new technologies development, we have seen a massive adoption process of new products in the market, thus transforming into innovations that, in turn, change patterns and behaviors in our society.

Recently, we have witnessed how information technologies have advanced at exponential speed, which has allowed the application of software in various industries such as RETAIL (online retail shopping), DELIVERY (home delivery), FINTECH (Financial Technology Institutions), FOODTECH (food development), HEALTH TECH (information technologies applied in health) and BIOTECH (Developments in biotechnology), promote the generation of new business models, new market segments and this in turn requires modifications, adjustments and even more the creation of new laws to regulate the use of new technologies in each of the industries, when necessary.

In the case of FINTECH, for example, Mexico was one of the pioneer countries in the world introducing the new Financial Technology Institutions Law, at the end of 2017, together with the approval of its specific regulations and the inclusion of Sandbox-type schemes. This scheme allow testing / evaluating new business models that were not consider initially in the legislation, as a mechanism to continue promoting technological innovation and lower the barriers of entry, considering that is a highly regulated industry.

Twelve months after the approval of the new Law, 125 new STARTUPS (recently created and rapidly growing companies) focused on the Fintech area were created, therefore Mexico consolidated its position as one of the main Fintech ecosystems in the region of Latin America, driven mainly by growth in the Technologies for Managing Financial Institutions, Trading and Capital Markets, Wealth Management and Alternative Scoring, Identity and Fraud segments; in addition to the fact that the Fintech Law recognizes crypto currencies as virtual assets, a great advance towards promoting innovation.

When we then see all these segments driven in the new FINTECH industry, it is important to bear in mind that it is not only about the digitization of the processes in bank branches, but also about a change in philosophy and interaction between the various actors of the ecosystem, mainly related to services in this industry, as well as changes in behavioral paradigms. As a result of this new legislation in Mexico, in July 2021, together with the boost to the Private Equity investment industry that occurred at the beginning of 2016, thanks to the public policies implemented in the country, we see as One of the first UNICORNS in Mexico is a FINTECH: the startup CLIP, a platform for operations and digital payments, which raises an investment of $ 250 Million dollars.

“UNICORN” is the term used in the venture capital and private equity investment industry when a startup that has raised several investment rounds, arrives at a valuation of One Billion Dollars. In fact, in Latin America in recent months we have witnessed the birth of several Unicorns such as: KAVAK, Rappi, Nubank, dLocal, Uala, Afiniti, Adexus, Bitt, Crehana, Abartys Health, Huli, and YaEsta.com, where the year 2020 marked a record year for the region, as these startups raised an accumulated investment of $ 4.2 billion dollars.

II. BIOTECH, AGROTECH, FOODTECH, HEALTHTECH Y EDUTECH: NUEVAS TENDENCIAS DE INVERSIÓN EN LATAM

In addition to the investment records and birth of UNICORNS mainly in the FINTECH industry, even more interesting is that this momentum in Latin America continues in 2021. We continue to see impressive examples in terms of technological trends and changes associated with industries related to biotechnology and food such as NotCo, a food technology company that makes plant-based milk and meat substitutes, who closed another round of financing this year, a $ 235 million Series D round that gives it a valuation of $ 1.5 billion dollars.

Therefore when considering investment trends in the region, the main investors comment that in addition to the FINTECH industry, which is one of those that has generated the most interest, the new hot topic will definitely be BIOTECHNOLOGY. In addition, there are opportunities in the areas of FOODTECH and AGTECH that have a lot to offer, given the demand for a more sustainable and ecological production, as well as topics such as food production for the future, transformation of organic waste into high-quality proteins, optimization of land use and water use, all together with compliance with the ESG (Environmental, Social & Governance) impact indicators.

At the same time, the HEALTHTECH industry, associated with health and the use of information technologies, represents another of the areas of opportunity for investment in LATIN AMERICA. In each of these industries there are problems that impact millions of inhabitants, and solving those, results as an improvement in their quality of life, as technological developments and new business models allow to diminish the gap to access primary health care services.

III. INVESTMENT, STARTUPS AND CANNABIS: NEW LEGISLATION

Framed in this context of abundance of capital and where investors have their eyes on LATIN AMERICA, in addition to new technology trends, we are witnessing the disruption that is generated in the CANNABIS industry. This since new Laws have been approved globally in several countries, focused on legalizing this industry and promoting technological innovation for the benefit of health and society.

In 2013, Uruguay became the first country in the world to legalize recreational cannabis. Eight years later, it is still the only Latin American nation to do so, starting commercialization in 2017 with a harvest scheme under state control and sales through pharmacies for medical use and establishments that keep a user registry for recreational use. However, in this scheme, entrepreneurs have found limitations in the use of bank accounts for the commercialization of recreational use of cannabis due to international legislation related to banks, so they do not accept credit or debit cards and everything is handles cash, unlike sales for medicinal use.

In Argentina, Brazil, Chile, Colombia, and more recently Mexico, recreational cannabis has been decriminalized to varying degrees. In Colombia in 2016, a law was approved that regulates the production of cannabis for medicinal use and since then there has been a growth in the legal cultivation industry, with a scheme in which vulnerable farmers are given priority in the allocation of cultivation quotas, implementing alternative monitoring mechanisms, when granting licenses, thus seeking to generate a positive social impact.

In Argentina, studies have already begun on the use of cannabis in pain associated with cancer. It is the first chronic pain trial to be done with cannabis oil produced in that country. The new regulation on the medicinal use of cannabis authorized the self-cultivation of this plant for medicinal purposes and expanded its use beyond some epilepsy types.

On the other hand, in Mexico in April 2017, reforms to the General Health Law were approved to allow the use, export and import of cannabis products for medical and scientific purposes. While in November 2018, in the Federal Commission for the Protection Against Sanitary Risks (COFEPRIS) announced the release of 38 permits to various companies to produce raw materials, food, beverages, food supplements, cosmetics and pharmaceuticals based on cannabis. The decision involves 21 supplements, nine cosmetics, six foods and two raw materials. Later, these permits were suspended and the holders presented legal protection in order to continue with the commercialization. Currently there are some products with valid permits on the market.

Likewise in January 2021, the Regulation of the General Health Law on Sanitary Control for the Production, Research and Medicinal Use of Cannabis and its Pharmacological Derivatives was published, which establishes that COFEPRIS will be responsible for issuing licenses for the production, research and prescription of cannabis for medical purposes. This Law regulates in Mexico the primary production of cannabis, its experimentation for health, pharmacological research, the manufacture of drugs and its medical use in diagnosis, prevention, therapy, rehabilitation and palliative care. Permits are also contemplated for professionals who wish to do medical research on cannabis, planting for research and manufacturing purposes, as well as prescription of drugs.

Later, in June 2021, the National Supreme Court of Justice approved a historic ruling that eliminates the articles of the General Health Law that prohibited the consumption of recreational cannabis, however in Mexico its use continues to be penalized in the Penal Code, while the sanitary regulator has not designed the mechanism to grant authorizations for self-consumption.

In this continuously changing context, according to Euromonitor, by 2020 data on the global CANNABIS market and its derivative reported products, is in the order of $150 Billion Dollars, which is why this industry, which in turn is related to trends in Investment and technological innovation in the region, as it is in what has to do with AGTECH, BIOTECH, FOODTECH, HEALTHTECH and FINTECH, represents one of the largest areas of opportunity for investors, businessmen and entrepreneurs.

In the United States, it is estimated that the legal sale of CANNABIS will be about $28 Billion Dollars by 2022 and with a growth of 50% in 4 years, to reach about $ 42 Billion Dollars in 2026. Meanwhile in Mexico it is estimated that the value of the medicinal market will grow from $ 3.5 Million in 2021 to more than $ 50 Million in 2024.

In a similar way, as what happen in the FINTECH industry when the creation of a new Fintech Law was promoted in Mexico, now we are observing that being in a moment of transition towards legality in the CANNABIS industry, an important amount of investments in the region are confirming the immense potential it represents in various areas.

In the field of mergers and acquisitions in LATIN AMERICA, as well as in the reports of foreign direct investment in the region, there are reports of cross-border mergers and acquisitions, three of which are of interest to technology-intensive sectors related to health: pharmaceuticals, biotechnology and renewable energy. It is striking, for example, that, in the pharmaceutical sector, the Colombian Blueberries Medical Corp. acquired BBV Labs, a certified laboratory for the production of medicinal cannabis and derivatives. Meanwhile in Uruguay it is reported that, in the last decade, the sectors with outstanding investment opportunities are agribusiness, forestry, timber, cannabis, global services (made up of business services, software services and information technologies, trade services, financial services and creative services), and renewable energy. In fact, the largest investment announcement in 2020 was made by a Canadian company, Boreal, which inaugurated a medicinal hemp processing plant, the largest in Latin America to date (Pharmabiz, 2020), with an estimated investment of $ 28 million of dollars.

Likewise, in the United States, for example, where there is a great trajectory in Startups investment and also in some of its States the use of CANNABIS has already been legalized, a very interesting behavior is observed where it is worth highlighting the following amounts and areas in the period from 2016 to Q2 of 2021:

  • The accumulated total investment in startups related to CANNABIS is $ 10,734 Million dollars
  • At least 1,711 transactions have been made with the following distribution by industry in trillions of dollars:
    • Health: $ 3.61 Billion Dollars, distributed as follows
      • Pharmaceutical drugs: $ 1.79 Billion
      • Biotechnology: $ 787.03 Million
      • Alternative Medicine: $ 378.16 Million
      • Clinics and Services: $ 82.06 Million
      • Drug manufacturing: $ 164.49 Million
      • Drug development: $ 140.55 Million
    • Consumer products and services: $ 2.85 Billion
    • Internet: $ 1.3 Billion
    • Agriculture: $ 1.19 Billion
    • Telecommunications and cell phones: $ 530.68 Million
    • Food and beverages: $ 265.98 Million
    • Service businesses: $ 166.51 Million
    • Finance: $ 442.66 Million
    • Retail: $ 110.6 Million
    • Industrial processing $ 96.57 Million
    • Software: $ 125 Million
    • Electronics: $ 97.66 Million
    • Environmental remediation: $ 1.4 Million

In this context, 2020 has been mainly a good year for CANNABIS startups in the US, as the pandemic translated into a greater increase than expected in recreational and medicinal consumption, an increase in electronic commerce and the demand for home deliveries for products with CANNABIS, growth in the demand for beverages with formulations that include CANNABIS compounds, growth in FINTECH companies offering credits to companies in charge of plant cultivation, demand for automated systems with robots for growing CANNABIS flowers, demand in the use of plant cultivation management software and inventory control of products linked to the end customer, increase in demand for ecommerce software that connects the end user and the product provider, increase of the Marketplace for wholesale and distribution of cosmetic and food products, as well as demand in cannabinoid products generated from bio-synthesis processes and new medical devices for compound detection or vaporizer design. In short, the possibilities are endless.

IV. CANNABIS AND INTELLECTUAL PROPERTY

If we consider the trends regarding the protection of technologies through the figure of patents, in the period from 2016 to mid-2021, at least an accumulated of 3,083 new patents pending and granted are identified, mainly related to health focused on the areas of:

  • Cannabionoids
  • Drug design
  • Phenols
  • Enteogens or Benzochromenes
  • HDAC inhibitors

Meanwhile, in terms of trademark registration in Mexico, until the end of 2019, more than 549 registered trademarks related to cannabis have been reported, where the pharmaceutical sector accumulates 122 of these registered according to Endeavour Report. Similarly, 3,939 trademark registrations are identified in Canada and 2,138 in the United States.
